✦ Terms of Service ✦

The buyer/commissioner must agree to all terms of service before proceeding with the commission/purchase.
Payment for a service is considered implicit agreement to all terms of service.
Agreement to the terms of service cannot be retracted.

GENERAL TERMS
- All drawings will include a subtle signature that you MAY NOT remove.
- Prices are subject to change. If you commission me multiple times, the price may not stay the same.
- I have the right to reject any order or adopt bid for ANY reason.PAYMENT
- Currency accepted in USD and must be paid through PayPal, Venmo, or Zelle.
- All commissions must be paid in full AT LATEST after we settle upon a sketch.
- Do not send me payment until I have agreed to give you a slot and we have decided on a basic description of the commission.PROCESS AND DELIVERY
- I will notify you when I have started on your commission. You will then lose the rights to a refund (see below for more on refunds.)
- I will send a sketch, base colors, and a final product. If you want more in-between progress images let me know.
- You MAY NOT USE progress or sketch images in any way, including with AI.
- Turnaround time is usually 1-3 weeks. I will let you know if there are any changes or delays.
- Once the piece is finished you will receive the full image. Let me know if you want me to email it to you as well as send it through DMS.REVISIONS
- Final revisions like adding a small accessory are fine, but all other composition and color revisions are to be revised during the sketch and base color progress images, respectively. If you want something changed on the final drawing, or if you want a change in something you were previously satisfied with, I will charge an extra fee to change it (unless it was a mistake on my part.)COPYRIGHT/USAGE POLICY
- I, the artist, claim the rights to the produced drawing. The buyer does NOT obtain the rights, neither during the process nor upon completion. I am allowed to use the copyrighted artwork to promote myself, display it, and post it wherever.The buyer is allowed to do the below, with explicit credit to me:
- use the commissioned piece for non-commercial personal use
- print the artwork and claim the character or design (if their own) as their own, but not the artwork itself
- use the artwork to promote themselves
- use artwork on YouTube/Twitch/etc. channels as long as the artwork is not the main reason for their earnings (i.e. as a pfp, header, logo, etc.)The following is considered copyright infringement:
- reproducing/using the copyrighted artwork commercially/making money off it in any way
- claiming the artwork as your own (or design, if it was done by me)
- removing my signature from the artwork
- altering the artwork without my consent
- using the image for Artificial Intelligence (AI) generation or alterations
I reserve the full rights to the image and its use/distribution unless otherwise agreed upon.CRYPTO/NFT/AI POLICY
You may not use my art for anything related to crypto, NFTs, or AI. If you are someone who engages with NFTs or AI art, you MAY NOT commission me or use my art. If I find out you have violated this rule, I will cease working on your commission and publicize your violation. All usage of my art in violation of this is considered illicit.REFUND/CANCELLATION POLICY
- The buyer is not allowed a refund once I start working on the commission (which I will notify you of.)
- If for any reason I am unable to start or complete your commission, you will receive a full refund.
- If you cancel your order before I start, you will receive a full refund.
- If you are receiving a refund, do not request a chargeback. I will transfer the money back to you myself.
- If you request a chargeback at any point after you lose the right to a refund, you will lose all aforementioned rights to the commissioned piece and I will have the full right to profit further from it in any way. I will also decline the chargeback and give the relevant entities our conversations in which you agreed to the ToS and where we talk about the commission as evidence that I have completed work for you. You will also be blacklisted for commissioning me and other artists I know.

ADOPT/DESIGN POLICIES
In addition to aforementioned general commissions policies:
꧁ only non-commercial use rights are included for adopts (you cannot use as a mascot or persona, because it contributes directly to monetary or social gain); caveat for design pieces explicitly for this purpose, which are subject to further discussion
꧁ do not resell the adopt or design unless explicitly stated otherwise (or marked as tradeable/resellable on toyhouse)
꧁ please credit when reposting my art; credit me as the designer if posting on toyhouse or related oc sites that have a spot for design credit
꧁ changes to the design or character are okay after purchase

If the buyer breaks any of the points stated above they will lose all aforementioned rights to the artwork commissioned by me, the artist, and I will have the right to profit further from the commissioned artwork in any way I see fit. If you have a problem with any of these statements, they may be changed if discussed with me prior to purchasing the adopt or design.
